These Terms & Conditions apply to bookings made through Labuan Bajo Trip.
By making a booking and/or payment, the customer acknowledges that they have read, understood,
and agreed to these Terms & Conditions and the applicable booking information provided before payment.

1. Booking Confirmation And Payment

  • Full payment (100%) is required at the time of confirmation..
  • All payments must be completed before the trip begins in order for the booking to proceed. If payment is not received within the stated deadlines, we have reserves the right to cancel or release the booking and retain any payments already made.

2. Cancellation Policy

  • Any cancellation made by the Guest for any reason whatsoever shall be strictly non-refundable.
  • The booking may be transferred to a substitute participant, subject to prior written notification and approval by the Company.
  • In the event of cancellation or sailing prohibition imposed by the harbourmaster, government authority, or any competent authority due to adverse weather conditions, force majeure, natural disasters, acts of terrorism, political unrest, or other circumstances beyond reasonable control, the Guest shall be entitled to either: (a) reschedule the trip; or (b) receive a full refund of payments made.
  • If cancellation is initiated by the boat operator due to unavoidable circumstances, including but not limited to sudden technical failure, the operator shall use reasonable efforts to provide a replacement vessel of equivalent class and price range.
  • If a suitable replacement cannot be provided, the Guest shall be entitled to a full refund.

3. Cancellation of Trip Due to Force Majeure

  • Events occurring outside Indonesia that do not directly affect travel operations within Indonesia shall not be considered valid grounds for cancellation, refund, or compensation beyond the standard cancellation policy.
  • Only Force Majeure Events that directly impact the safety, feasibility, or operation of the trip within Indonesia shall be considered under this clause.
  • If a Force Majeure Event does not affect travel operations within Indonesia, it will not be considered valid under this clause, and standard cancellation policies will apply.
  • Where a trip is unable to proceed as planned due to Force Majeure, labuan bajo Trip, at its discretion and subject to operator policies, offer one of the following:
    1. Rescheduling to a future date, typically within twelve (12) months, subject to availability; or
    2. Partial refund, strictly limited to amounts recoverable from the vessel operator or third-party providers.
    3. If a traveler chooses to cancel due to a Force Majeure Event, standard cancellation policies shall apply unless otherwise stated.

    4. Rescheduling

    • Requests for rescheduling must be submitted no later than thirty (30) calendar days prior to departure.
    • Requests submitted less than thirty (30) days before departure shall result in forfeiture of the down payment.

    5. Tour Information

    Tour descriptions, itineraries, photographs, schedules, inclusions, exclusions, and prices are provided based on information available at the time of publication or booking.

    We make reasonable efforts to ensure that this information is accurate. However, marine tours and travel activities in Flores are affected by weather, sea conditions, operational circumstances, government regulations, harbourmaster instructions, and other circumstances beyond our direct control.

    6. Itinerary Changes

    Published itineraries represent the intended travel program. The order of destinations, departure time, duration at destinations, snorkeling locations, trekking activities, or other elements of the itinerary may be changed when necessary due to:

    • Weather conditions
    • Sea conditions
    • Safety considerations
    • Harbourmaster (Syahbandar) instructions
    • Komodo National Park regulations
    • Government restrictions
    • Operational circumstances
    • Vessel conditions
    • Natural disasters
    • Force majeure
    • Other circumstances beyond reasonable control

    Such changes do not automatically constitute cancellation of the entire tour.

    7. Boat and Cabin Information

    Boat photographs and specifications are provided to help guests understand the vessel and cabin category being booked.
    Minor differences may occur due to maintenance, refurbishment, equipment replacement, or operational changes.
    If the originally confirmed vessel becomes unavailable because of mechanical, operational, regulatory, or safety reasons, Labuan Bajo Trip may offer an alternative vessel or alternative arrangement where reasonably possible.
    Any material change will be communicated to the guest.

    8. Komodo National Park Fees

    Unless specifically stated as included, Komodo National Park entrance fees and other government-imposed fees are not included in the tour price. Government fees may change without prior notice.
    Labuan Bajo Trip does not control fees determined by government authorities.

    9. Guest Responsibilities

    Guests are responsible for:

    • Providing accurate personal and passport information
    • Arriving at the designated meeting point on time
    • Following safety instructions
    • Following instructions from guides and boat crew
    • Respecting Komodo National Park regulations
    • Carrying appropriate personal travel documents
    • Informing us of relevant dietary requirements or mobility requirements before departure
    • Taking reasonable care of their personal belongings

    International guests are responsible for ensuring that they have valid passports, visas, travel documents, and any other documentation required to enter and travel within Indonesia.

    10. Travel Insurance

    • Labuan Bajo Trip strongly recommends that each Guest obtain comprehensive travel insurance before commencing the trip.
    • The insurance policy should, where applicable, provide coverage for medical expenses, personal accidents, emergency medical evacuation, personal liability, loss of or damage to personal belongings and baggage, trip cancellation or interruption, and other travel-related risks.
    • Labuan Bajo Trip shall not be held responsible for any injury, loss, damage, delay, cancellation, or expense arising from circumstances beyond its reasonable control or from risks, losses, or expenses that are not covered by the Guest’s travel insurance.
    • Guests are responsible for reviewing the terms, conditions, exclusions, and coverage limits of their insurance policy and ensuring that it adequately covers the nature and activities of their trip.

    11. Personal Belongings

    Guests remain responsible for their personal belongings during the trip.
    Labuan Bajo Trip is not responsible for loss, theft, or damage to personal belongings except where liability cannot legally be excluded.

    12. Safety

    Guests must follow reasonable safety instructions provided by the captain, crew, guide, National Park ranger, or relevant authorities.
    A captain or tour operator may modify or discontinue an activity when continuing would present an unreasonable safety risk.

    13. Force Majeure

    Events outside our reasonable control may include, but are not limited to:

    • Severe weather
    • Dangerous sea conditions
    • Earthquakes
    • Volcanic activity
    • Tsunamis
    • Flooding
    • Natural disasters
    • Government restrictions
    • Harbour closures
    • Syahbandar restrictions
    • National Park closures
    • Civil emergencies
    • Epidemics or pandemics
    • Transportation disruption
    • Other extraordinary events beyond reasonable control

    When a tour is affected by such circumstances, Labuan Bajo Trip will make reasonable efforts to provide available alternatives in accordance with the circumstances and applicable supplier policies.

    14. Third-Party Providers

    Certain components of our tours may be provided by independent third parties, including boat owners/operators, hotels, drivers, guides, airlines, restaurants, and other tourism providers.
    Their own operational and safety rules may apply in addition to these Terms & Conditions.

    15. Complaints and Claims

    • Any complaint regarding services during the trip must be reported immediately to the Guide or Cruise Director onboard to allow prompt resolution.
    • Claims submitted after completion of the trip shall not be entertained.

    16. Documentation and Publicity Rights

    • The trip includes complimentary documentation services. By participating, the Guest grants consent to be photographed and/or recorded.
    • The Company reserves the unrestricted right to use such materials for marketing, promotional, and social media purposes without additional consent or compensation.
    • Any objection to specific published materials must be submitted in writing to the Admin for review.

    17. Limitation Of Liability

    • The Company acts solely as a tour organizer and shall not be liable for any loss, injury, damage, accident, delay, or irregularity caused by third-party service providers, including but not limited to boat operators, guides, transportation providers, or accommodation providers.
    • To the fullest extent permitted by applicable law, the Company’s total liability arising out of or in connection with the trip shall not exceed the total amount paid by the Guest for the booking.
    • The Company shall not be responsible for indirect, incidental, consequential, or punitive damages of any kind..

    18. Indemnification

    The Guest agrees to indemnify and hold harmless the Company, its directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, or expenses arising from the Guest’s participation in the trip, misconduct, negligence, or violation of applicable laws.

    19. Governing Law And  Dispute Resolution

    • These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Indonesia.
    • Any dispute arising out of or in connection with these Terms shall first be resolved amicably through mutual discussion.
    • In the event no amicable resolution is reached, the dispute shall be subject to the exclusive jurisdiction of the competent courts of the Republic of Indonesia.

    20. Acceptance Of Terms

    By making any payment, whether partial or full, the Guest acknowledges that they have read, understood, and agreed to be legally bound by these Terms and Conditions in their entirety.
