A booking shall be deemed confirmed only upon receipt of a minimum down payment of fifty percent (50%) of the total purchase amount.
The remaining balance must be fully settled no later than fourteen (14) calendar days prior to the departure date.
Failure to complete the final payment within the prescribed period shall entitle the Company to cancel the booking
Any cancellation made by the Guest for any reason whatsoever shall be strictly non-refundable.
The booking may be transferred to a substitute participant, subject to prior written notification and approval by the Company.
In the event of cancellation or sailing prohibition imposed by the harbourmaster, government authority, or any competent authority due to adverse weather conditions, force majeure, natural disasters, acts of terrorism, political unrest, or other circumstances beyond reasonable control, the Guest shall be entitled to either: (a) reschedule the trip; or (b) receive a full refund of payments made.
If cancellation is initiated by the boat operator due to unavoidable circumstances, including but not limited to sudden technical failure, the operator shall use reasonable efforts to provide a replacement vessel of equivalent class and price range.
If a suitable replacement cannot be provided, the Guest shall be entitled to a full refund. In the event of cancellation or sailing prohibition imposed by the harbourmaster, government authority, or any competent authority due to adverse weather conditions, force majeure, natural disasters, acts of terrorism, political unrest, or other circumstances beyond reasonable control, the Guest shall be entitled to either:
(a) reschedule the trip; or
(b) receive a full refund of payments made.
Requests for rescheduling must be submitted no later than thirty (30) calendar days prior to departure.
Requests submitted less than thirty (30) days before departure shall result in forfeiture of the down payment.
The Company strongly recommends that each Guest obtain comprehensive personal travel insurance.
Such insurance should include coverage for medical expenses, personal accident, emergency evacuation, personal liability, loss of belongings, baggage, and other related risks.
The Company shall not be held liable for any injury, loss, damage, delay, or expense arising from circumstances beyond its direct control or not covered by the Guest’s personal insurance.
The Company acts solely as a tour organizer and shall not be liable for any loss, injury, damage, accident, delay, or irregularity caused by third-party service providers, including but not limited to boat operators, guides, transportation providers, or accommodation providers.
To the fullest extent permitted by applicable law, the Company’s total liability arising out of or in connection with the trip shall not exceed the total amount paid by the Guest for the booking.
The Company shall not be responsible for indirect, incidental, consequential, or punitive damages of any kind.
The Company shall not be deemed in breach of these Terms and Conditions nor liable for delay or failure to perform any obligation where such delay or failure results from events beyond reasonable control, including but not limited to acts of God, natural disasters, government restrictions, weather conditions, civil unrest, pandemics, or other unforeseeable events.
Any complaint regarding services during the trip must be reported immediately to the Guide or Cruise Director onboard to allow prompt resolution.
Claims submitted after completion of the trip shall not be entertained.
The trip includes complimentary documentation services. By participating, the Guest grants consent to be photographed and/or recorded.
The Company reserves the unrestricted right to use such materials for marketing, promotional, and social media purposes without additional consent or compensation.
Any objection to specific published materials must be submitted in writing to the Admin for review.
The Guest agrees to indemnify and hold harmless the Company, its directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, or expenses arising from the Guest’s participation in the trip, misconduct, negligence, or violation of applicable laws.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Indonesia.
Any dispute arising out of or in connection with these Terms shall first be resolved amicably through mutual discussion. 3. In the event no amicable resolution is reached, the dispute shall be subject to the exclusive jurisdiction of the competent courts of the Republic of Indonesia.
By making any payment, whether partial or full, the Guest acknowledges that they have read, understood, and agreed to be legally bound by these Terms and Conditions in their entirety.
